Terms and Conditions

  1. The Promoter is Together Mutual Insurance, Kings Court, London Road, Stevenage, Herts, SG1 2TP.
  2. By submitting an entry to this Promotion, entrants agree to be bound by these Terms and Conditions.
  3. Entry instructions form part of these Terms and Conditions. Entries submitted with incomplete information, or found to contain invalid information, shall be deemed invalid entries.
  4. Entry is open to residents of Great Britain (England, Scotland and Wales – full regional breakdown below point 26) aged 18 and over. Entries from Ireland, Northern Ireland or the Channel Islands will not be considered. Directors, management and employees (and the immediate families of directors, management and employees) of the Promoter or the agencies or companies associated with this Promotion are not permitted to enter the Promotion.
  5. To enter, entrants must fill out the online entry form via the Britain Has Spirit website or app. Entries will only be considered when entered online through the website or app. No entries received by post will be valid and cannot be returned by the Promoter. The entry must be completed and submitted to be valid with at least one photo or video. The entrant must press submit to complete the nomination.
  6. One nomination per email address only will be accepted. Duplications by the same email address will not be possible.
  7. No automated, third party or bulk entries are permitted. Multiple entries in breach of this provision will result in those entries being disqualified. If the Promoter becomes aware of an entrant using means to circumvent this condition then these entries will be disqualified and any prize entitlement will be void.
  8. Upon submission of an entry, entrants assign in full and grant the Promoter a sole, perpetual, worldwide, unlimited, freely assignable, royalty free license in any intellectual property rights or other rights vested in the entry. Entrants agree to carry out any further actions required in order to satisfy this term.
  9. The Promotion commences on 25th January 2016 and will close on a date to be specified by the Promoter. For the avoidance of doubt, all regional nominations must have been received by the Promoter by the close of the “Nomination Period” (25th January 2016 to 26th February 2016) in order to meet the “Nomination Period” Closing Date validity requirements.
  10. All 12 regional shortlists will be selected:
    By a panel that includes at least one independent member, to be held on a date to be specified by the Promoter (the “Selection Date”). Details of panel members may be obtained (after the Selection Date) by writing to the Promoter. The panel will assess all valid entries. The entries that the majority consider in their subjective opinion to be worthy winners (based on at least one photo or video uploaded and a persuasive argument to show how the nominee has made a notable change and benefitted the local area or community, physically or through engagement) shall be deemed part of the shortlist and will be put forward for public vote. There will be a maximum of 5 Regional Community Initiative of the Year nominations and 5 Regional Community Hero of the Year nominations per region.
  11. Regional winners will be notified of the fact that they have won within 20 days of the regional vote closing by email/SMS/telephone. They will then be asked to supply details for delivery of their prize. Prizes shall be delivered within 30 days of the Closing Date.
    National winners will be selected:
    By the general public through an online voting channel for one National Community Initiative of the Year winner and one National Community Hero of the Year winner. The entries that receive the majority shall be deemed the overall winners and announced at an awards ceremony. All regional winners will be invited. The Promoter reserves the right to allocate a maximum number of tickets per regional winner. The means of payment will be at the Promoters discretion and payable directly to the agreed local community project, charity or initiative.
    The Promoter reserves the right to choose regional and national winners if the voting process results in a tie.
  12. The Promoter will use reasonable endeavours to contact the regional winners using the contact details supplied upon nomination to the Promotion. If a winner does not respond within 7 working days of the first notification, then that individual forfeits the right to claim the Prize and the Promoter is free to nominate another winner as appropriate.
  13. The Promoter reserves the right to cancel, amend, terminate or temporarily suspend this competition at any time with no liability to any entrant or any third party.
  14. The following prizes are available to be won:
    Per region:
    1 group prize: ‘Regional Community Initiative of the Year’ – sum total of £1,000 that must be spent towards organising a street party for the local community relevant to the nomination
    1 individual prize ‘Regional Community Hero of the Year’ – an experience day voucher, total prize sum at the discretion of the Promoter.
    Per national winner
    1 group prize: ‘National Community Initiative of the Year’ - £25,000 towards a local community project, charity or initiative
    1 individual prize: ‘National Community Hero of the Year’ - £25,000 towards a local community project, charity or initiative
  15. No cash or alternative prizes are available, with the exception that in the event of circumstances outside of its control, The Promoter reserves the right to award similar prizes of equal or greater value.
  16. If for any reason any aspect of the Promotion does not function correctly, whether by means of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter that corrupts or affects the administration, integrity or fairness of the Promotion, then the Promoter may at its sole discretion cancel, modify or suspend the Promotion and/or invalidate affected entries.
  17. The Promoter and its associated agencies and companies accept no liability for any loss, expense or damage which is suffered or sustained (whether or not arising from any person's negligence) in connection with the Promotion and/or prizes, other than such liability that cannot be excluded by law including death or personal injury caused by negligence, where liability shall be limited to the minimum permissible by law.
  18. If there are reasonable grounds to believe that there has been a breach of these Terms and Conditions by an entrant, The Promoter may, at its sole discretion invalidate the relevant entry and disqualify the entrant from the Promotion, irrespective of the stage in the Promotion reached.
  19. The Promoter’s decision in all matters relating to the Promotion is final and binding and no correspondence will be entered into.
  20. The regional and national winners agree to take part for free in any publicity for the Promotion as requested by the Promoter. This will include but not be exclusive of, media and marketing promotional activity, television appearances, radio interviews, activity across social channel, use of imagery and video content. Winners agree to the use of their image, name, likeness and video content for all activity concerned with the Promotion.
  21. Names and counties of residence of the regional winners will be available upon request after the selection Date in writing to the Promoter, marked “Winners List – Britain Has Spirit”.
  22. This Promotion is subject to English, Scottish and Welsh law and the exclusive jurisdiction of the English courts.

  24. Entries must be the entrant’s own original creations, not in violation of third party intellectual property rights, and if the entries do incorporate any third party elements, entrants must have the permission of the rights holder to do so prior submission.
    Entries must not contain any elements that are or are likely to be perceived as: offensive; of an explicit sexual nature; depictions or descriptions of graphic violence; sexist; racist; homophobic; commercially sensitive; defamatory; in breach of the rights of others; or otherwise illegal, unacceptable or inappropriate content.
  25. Entrants hereby release Facebook, Twitter, and Instagram of all liability that can be excluded under English, Scottish and Welsh law.
    This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, and Instagram. Entrants should be aware that they are providing information to Together Mutual Insurance and not to Facebook, Twitter, and Instagram.
